General terms of car rental

This agreement is drawn up and takes effect on the date shown overleaf. It binds the car rental company “l'agence”, called the “lessor”, and the person, company or organisation signing it, called the “renter”. Courtesy translation: the French text prevails.

Article 1 · Use of the car

The renter undertakes not to let anyone drive the car other than themselves or persons approved by the lessor for whom they vouch, and to use the vehicle for personal needs only. Taking part in any kind of competition, using the vehicle for unlawful purposes or carrying goods is forbidden. The renter undertakes not to request customs documents directly. The renter must not overload the vehicle by carrying more passengers than stated in the contract, failing which insurance cover is forfeited.

Article 2 · Condition of the car

The car is delivered in perfect running order and clean. The odometers and their connections are sealed; the seals must not be removed or broken, otherwise the rental is payable on the basis of 250 kilometres per day. The renter bears the cost of cleaning and restoration. The 5 tyres are in good condition with no wear other than normal wear. If any of them is damaged other than by normal wear, the renter must replace it immediately with a tyre of the same size and of substantially equal wear, or pay its cost.

Article 3 · Fuel and oil

Fuel is at the renter’s expense. The renter must constantly check the oil and water levels, and the gearbox and rear axle levels every 1,000 km. The renter must justify any work with the corresponding invoices (which will be reimbursed), failing which an indemnity for abnormal wear is payable.

Article 4 · Maintenance and repairs

Normal mechanical wear is borne by the lessor. All repairs resulting from abnormal wear, from the renter’s negligence or from an accident are at the renter’s expense and carried out by the lessor.

If the vehicle is immobilised outside the region, repairs, whether due to normal wear or to an accident, are only carried out after the lessor’s written agreement with the brand’s regional agent. They must be supported by a detailed, paid invoice, and the defective replaced parts must be shown with that invoice.

Under no circumstances may the renter claim damages for late delivery of the car, cancellation of the rental, or immobilisation caused by repairs required by normal wear and carried out during the rental. Liability towards persons or property resulting from manufacturing defects or from earlier repairs lies with the lessor.

Article 5 · Insurance

1) The rented vehicle is covered against theft and fire, excluding clothing and all objects carried.

2) The driver and passengers are also covered. The vehicle is not allowed on tracks. Any damage whatsoever caused by misuse remains the renter’s responsibility. The car is insured only for the duration of the rental: after that, the lessor accepts no liability for accidents the renter may cause, which the renter must handle personally. There is no insurance for a driver without a valid licence or holding a licence for less than one year.

3) Damage to the vehicle: in case of damage, the renter’s liability is limited to the excess stated in the tariff in force on the rental date. This excess, which does not exceed 20% of the vehicle’s actual value, is used to pay the cost of restoration. Any balance is returned to the renter once repairs are completed and any recourse has concluded.

Article 6 · Rental, deposit, extension

Rental prices and the deposit are set by the tariffs in force and are payable in advance. The deposit may never be used to extend the rental.

To avoid any dispute, if the renter wishes to keep the car beyond the date stated in the contract, they must, after obtaining the lessor’s agreement, send the amount of the additional rental 48 hours before the current rental expires, failing which they risk legal proceedings for misappropriation of the vehicle and breach of trust. A rental day runs from 0:00 to 24:00, and any day started is due in full.

Article 7 · Repatriation of the car

The renter is strictly forbidden to abandon the vehicle, whatever the cause (accident or breakdown). If this is materially impossible, the vehicle is repatriated at the renter’s expense and by the renter’s care.

Article 8 · Cancellation

Cancellation is free up to 48 hours before pick-up. After that, or in case of no-show, the renter must pay 20% of the rental amount, whatever its duration.

Article 9 · Vehicle documents

The renter hands over, at the end of the rental and on return of the car, the registration certificate and all documents necessary for its circulation. Otherwise, as these documents are indispensable for new rentals, the rental continues to be invoiced at the initial price until they are handed back to the lessor. If these documents are lost, the renter pays the cost of duplicates.

Article 10 · Liability

The renter remains solely responsible for thefts of car parts, fines, offences and reports drawn up against them during the rental.

Article 11 · Jurisdiction

This agreement is governed by Moroccan law. In case of dispute, the parties first seek an amicable solution; failing that, the courts with jurisdiction over the lessor’s registered office have sole jurisdiction.

Article 12 · Identity documents and personal data

The renter gives the lessor a legible copy of their identity document (national ID card or passport) and driving licence. The lessor keeps these documents solely to draw up and perform this agreement, to prevent fraud and to meet its legal obligations, in accordance with Law No. 09-08 on the protection of individuals with regard to the processing of personal data. The renter may exercise their rights of access, rectification and objection with the lessor. The documents are deleted at the end of the necessary retention period, unless the law requires otherwise.

Article 13 · Role of the Locavi platform

The booking was made through the Locavi platform, a mere technical intermediary. Locavi is neither the lessor, nor the owner of the vehicles, nor the insurer, nor a party to this agreement. The lessor alone is responsible for the condition, compliance, insurance and availability of the vehicle and for performing the agreement; the renter alone is responsible for how they use it. Any claim relating to the rental (damage, accident, theft, delay, refund, deposit) must be addressed to the lessor. Locavi cannot be held liable for damage, loss, delay or disputes arising from the rental, except in case of its gross negligence or wilful misconduct.

Article 14 · Electronic evidence and signature

The parties agree that this agreement may be drawn up, signed and stored electronically, and that computer records (online acceptance, timestamps, SHA-256 digital fingerprint of the document, scanned handwritten signatures, copies of documents) constitute evidence of the exchanges and their content, unless proven otherwise, in accordance with Law No. 53-05 on the electronic exchange of legal data. The renter acknowledges having received a copy of the agreement. It is made in two copies; the French version prevails, translations being provided as a courtesy.
